A new expert opinion presented by the Italian public prosecutor's office contradicts the previous assumption that an extreme storm caused the luxury yacht "Bayesian" to capsize. The investigators classify the weather event as controllable and focus instead on the crew. Three crew members are accused of underestimating the risk and failing to react appropriately.

The public prosecutor's office in Termini Imerese has fundamentally revised its assessment of the sinking of the 56-metre sailing yacht "Bayesian". Several international media, including the Independent, the New York Post and Sky News, are unanimous in their reports.

A meteorological report concludes that the storm off the coast of Sicily on 19 August 2024 was not an exceptional natural event. The experts categorise the weather event as a sudden increase in wind caused by a thunderstorm - dangerous, but manageable for experienced sailors.

This reassessment contradicts the Marine Accident Investigation Branch (MAIB). The British investigating authority had identified significant structural defects in the ship as the main cause. Seven people lost their lives in the accident, including the British tech billionaire and owner of the "Bayesain" Mike Lynch and his 18-year-old daughter Hannah. The "Bayesian" had previously travelled from Cefalù to Porticello in order to shelter from the predicted onset of bad weather. A total of 22 people were on board on the night of the accident.

Weather report contradicts extreme weather thesis

The meteorological report commissioned by the Italian public prosecutor's office describes the weather conditions on the night of the accident very differently than previously assumed. The experts speak of a thunderstorm with a sudden increase in wind - nothing more than a gust that precedes thunderstorms and rainfall. Immediately after the accident, a coastguard official in Palermo stated that bad weather had been expected, but not to the extent observed.

Wind speeds of up to 145 km/h were measured on that day. Later investigations identified a so-called mesocyclone as the cause - a type of powerful rotating thunderstorm that can generate tornadoes or extreme gusts of wind. The Italian investigators are now re-evaluating this assessment. According to the latest expert opinion, the crew could and should have reacted to the weather conditions.

The reassessment shifts the focus from an unpredictable natural event to human error.

Focus on technical details and ship position

According to the investigation, two technical aspects played a central role in the sinking. The "Bayesian" was anchored in such a way that it was exposed to the gusts from the side - an unfavourable position in freshening winds. In addition, the movable keel was raised, which is common at anchor but significantly reduces stability in strong side gusts.

The MAIB report had already indicated that wind speeds of 63.4 knots on the side of the ship were sufficient to cause it to capsize. The British investigators found that the "Bayesian" would capsize at an angle of 70.6 degrees - contrary to the shipbuilder Italian Sea Group's claim that the vessel could right itself from 73 degrees. The stability manual apparently did not adequately describe the configuration with the keel raised. This grey area between design and operation is now part of the criminal investigation.

Three crew members under suspicion

The public prosecutor's office in Termini Imerese is investigating the New Zealand captain, the chief ship's mechanic and a deckhand. The possible charges include negligent shipwreck and multiple manslaughter offences. The deckhand, who was on night watch at the time of the accident, failed to recognise that the boat was taking on water, according to investigators. He is accused of negligence through misconduct, recklessness and inexperience. The two subordinates had not adequately informed the captain of the dangers.

The captain, on the other hand, had not warned the passengers of the impending accident. The sailor had testified that he had sounded the alarm during the night and informed the captain. The captain then took command and ordered the passengers sleeping inside the ship to be woken up. All three defendants are presumed innocent.

Course of the disaster reconstructed

The MAIB report reconstructs the events in minute detail. Shortly before four o'clock in the morning, the wind suddenly picked up and the anchor no longer held. The captain was preparing to turn the ship into the wind when the wind speed suddenly increased to more than 70 knots. The ship tilted 90 degrees to the right in less than 15 seconds. The sudden tilt immediately switched off the generators.

Lynch's widow Angela Bacares told doctors that the boat capsised at around four in the morning and that she and her husband were woken up. She was one of the 15 survivors. In addition to Lynch and his daughter, five other people died. The "Bayesian" sank within 16 minutes.

Shipbuilder rejects responsibility

Giovanni Costantino, head of the Italian Sea Group, had described the "Bayesian" as unsinkable and claimed that the crew must have left doors or hatches open, allowing water to enter. The Italian Sea Group filed a lawsuit against Lynch's widow in a Sicilian court and, according to media reports, is demanding over 460 million euros in damages.

The shipbuilder argued that the crew was responsible for the sinking. However, the MAIB report contradicted several of the manufacturer's claims. The British investigators found that the structure could have affected the stability of the boat during engine operation - weaknesses that were not listed in the yacht's stability manual.

Salvage completed after ten months

The "Bayesian" was salvaged ten months after it sank in an operation costing several million euros. The salvage work proved to be time-consuming, as the wreck lay at a considerable depth. A team of international experts has been examining the recovered wreck since then. The investigation should be completed by the second anniversary of the disaster in August.

Comparison with neighbouring ship

On the night of the disaster, the Dutch "Sir Robert Baden Powell" was anchored near the "Bayesian" in the bay off Porticello. This ship survived the storm without any significant damage. The comparison between the two ships raises questions about the reaction of the respective crews. The "Sir Robert Baden Powell" serves as a reference point for the investigators to assess whether the weather conditions were actually as extreme as initially assumed.

The different fates of the two ships in the same bay support the Italian investigators' theory that the weather alone was not responsible for the sinking. The crew of the "Sir Robert Baden Powell" could provide important witness statements on the weather conditions and the behaviour of the "Bayesian".
