In a statement issued on Friday, the New York Supreme Court said that due to current congestion, it saw no way to further discuss the issue of the country of manufacture of Alinghi's sails before the race. The 33rd America's Cup will take place as planned on 8, 10 and possibly 12 February off Valencia.
"This is excellent news," said two-time America's Cup winner Ernesto Bertarelli upon hearing the news, according to a press release issued by Alinghi. "We are delighted that BMW Oracle's attempts to disqualify Alinghi and win the America's Cup in court have been rejected. We look forward to facing them on the start line in Valencia on 8 February and sailing for the Cup."
