Schleswig-Holstein has its " State ordinance on measures to combat the spread of the novel coronavirus SARS-CoV-2 " has been amended. In Section 6 (8) and (at the very end) the explanatory memorandum to Section 6, it now stipulates the binding conditions under which marinas in the northernmost federal state may be used by berth holders from tomorrow. The regulations restrict the operation of the marinas far less than the proposals of the various experts had suggested. Whether this remains the case now depends on how they prove themselves in practice and whether the users of the marinas adhere to them.
§ Section 6(8): By way of derogation from paragraph 3(8), marinas may allow limited operation provided that showers and common areas, with the exception of toilet facilities, remain closed during the day.
Justification for § 6 paragraph 8: Recreational craft harbours may reopen to a limited extent. It is permitted to make the boat usable (transport from winter storage, craning or slipping and other measures to make the boat seaworthy), to use the boat and to enter and leave the harbour. The power and water supply must be restored. Otherwise, the hygiene rules according to § 9 and the ban on contact according to § 2 Para. 2 continue to apply. Restrictions apply to the operator of the marina with regard to the showers and communal areas. Frequent cleaning and disinfection must be ensured here. Overnight stays on the boat are only permitted if it has sanitary facilities. The marina toilets may not be used at night and must be closed.
Schleswig-Holstein has virtually taken the lead with the new rules. In Hamburg, the harbours are still closed to recreational sailing, while in Mecklenburg-Western Pomerania sailing alone or in pairs is permitted again, but foreign sailors are not yet allowed to re-enter.
